ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed alleging wilful disobedience of the order dated 03.03.2025 in W.A.No.301 of 2025.

2. In the counter-affidavit, which has now been filed by second respondent, it is revealed that along with re-employment, which was earlier granted, the Corporation has paid Rs.11,53,077/- to petitioner, which, according to Corporation, is the amount of backwages/arrears of salary.

Learned counsel for petitioner would submit that respondents have wrongly computed the arrears of salary and according to petitioner, he is entitled to Rs.13,29,198/-.

4. We find that the order, which is alleged to have been disobeyed, did not quantify the amount payable, but only stated arrears of salary to be paid. According to respondents, arrears of salary has been computed to Rs.11,53,077/-. Irrespective of whether that amount is correct or not, we are of the view that it cannot be treated as the case of wilful disobedience.

5. The contempt petition, therefore, is closed. Rule is discharged giving liberty to petitioner to claim the amount more than what has been already paid by respondents. (MANINDRA MOHAN SHRIVASTAVA, CJ) (G.ARUL MURUGAN,J) 05.12.2025 Index :
