ORDER
The petitioner, who was arrested and remanded to judicial custody on 03.02.2026 for the alleged offences under Sections 331 (4) and 305 (a) of BNS, in Crime No.267 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner snatched the Thali chain of the defacto-complainant while she was alone in the field. Hence the case.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 03.02.2026. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and strongly opposed the bail application on the ground that the petitioner has fourteen previous cases of similar nature.
5.The submission of the learned Government Advocate clearly demonstrates the petitioner's bad antecedents and character. Therefore, this Court is of the firm view that although the petitioner's liberty must be respected, when considering the societal interest, the petitioner being a repeat offender, if the petitioner is enlarged on bail, there is every possibility of recurrence of similar offences. Hence, this is not a fit case to enlarge the petitioner on bail.
