CRL.M.P.NO.9136 OF 2016 in Crl.A.NO.439 of 2014 P.N.PRAKASH, J.

The captioned Criminal Appeal has been preferred by the appellant/accused, being aggrieved over his conviction and sentence passed by the learned Sessions Judge, Magalir Neethi Mandram/Fast Track Mahila Court, Tiruvallur, having found him guilty of the offence under Section 376 IPC.

2. Pending the above appeal, the victim, H.Kalpana has moved the present petition, seeking to hand over her original Transfer Certificate which was marked as Ex.P10.

3. During the trial, the victim Kalpana was examined as PW.2 and in order to prove her age, her Transfer Certificate was marked as Ex.P10 through the concerned School Head Master, PW.11.

4. Learned counsel for the petitioner submits that the above said certificate is very much required in order to pursue higher studies and as she has also attended interview for a job and she has to produce the same.

5. Learned counsel appearing for the appellant and the learned Addl.Public Prosecutor have reported no objection for handing over the certificate to the petitioner.

6. In view of the above, this Court directs the Registry to take a Photostat copy of the Certificate, i.e. Ex.P10 and after certifying the same, keep it in the file and hand over the original Certificate (Ex.P10) on proper identification.
