ORDER

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the first respondent to take necessary action against the fifth respondent for violating the instructions issued by the first respondent's Circular in letter No.18339/C1/2012, dated 25.04.2012 by considering the petitioner's representation dated 04.02.2013. 2.

Heard Mr.N.Manokaran, learned counsel appearing for the petitioner, Mr.Richardson Wilson, learned Government Advocate appearing for the respondents 1 to 3 and Mr.N.S.Suganthan, learned Additional Public Prosecutor appearing for the fourth respondent.

The petitioner seeks direction to take action as against the fifth respondent as per the representation dated 04.02.2013 for some illegalities committed by the fifth respondent with illusion of sixth respondent herein. However, after a period of eight years, the direction sought for in this writ petition cannot be granted for the reason that the said representation dated 04.02.2013, may not be available with the file of the first respondent herein.

4. However, the petitioner is at liberty to submit a fresh representation to the first respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the first respondent is directed to conduct an enquiry on the representation submitted by the petitioner and pass orders on merits and in accordance with law, without expressing any of the merits of the writ petition. 5.
