2. Heard the learned counsel on either side.

3. Having regard to the reasons stated in the affidavit filed in support of the petition and without prejudice to the rights and contentions of the appellant in C.M.A.No.2760 of 2019, this petition is allowed as prayed for.

4. Registry is directed to number the cross appeal, if it is otherwise in order and post the same along with C.M.A.No.2760 of 2019 on 29.11.2021.
