Prayer:- Contempt Petition filed under Section 11 of the Contempt of Court Act to punish the respondents for heir willful disobedience of the Order dated 26.06.2024 made in W.P.No.16782 of 2024 and also direct the respondents to disburse the reasonable compensation for the superstructure of his hotel premises before commencement of its eviction or demolition proceedings. ORDER
Heard Mr.Jaishankarramakrishnan, learned Counsel appearing for the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for the first and second respondents and Mr.K.Jegannathan.
2. During the pendency of this petition, the landlord of the writ petitioner has filed a petition in WMP.No.26381 of 2025 in W.P.No.16782 of 2024 to recall the Order passed in the Writ Petition in W.P.No.16782 of 2024, contending that the major construction has been put up by them and the tenant is not entitled to compensation. Pending the contempt proceedings, it appears the second respondent had passed an Order on 24.06.2025 observing that the 2/4
writ petitioner/tenant is entitled to compensation in respect of the building and not in respect of the land.
3. Considering the rival claim, this Court by an Order dated 30.06.2025 had disposed of the Writ Miscellaneous Petition in WMP.No.26381 of 2025 by setting aside the Order of the second respondent and directed for fresh enquiry after giving opportunity to the parties concerned.
4. In such view of the matter, as the Order passed by the second respondent in pursuant to the Order of this Court in the Writ Petition is set aside, this Contempt Petition is closed.
