ORDER

This Contempt Petition has been filed seeking to punish the respondent for wilful disobedience of the order dated 06.02.2023 passed by this Court in Crl.O.P.No.2306 of 2023.

The learned counsel for the petitioner submitted that this Court while disposing of Crl.O.P.No.2306 of 2023, vide order dated 06.02.2023, had directed the Investigation Officer to issue notice to the parties concerned and conduct an enquiry strictly in accordance with the guidelines laid down by the Hon'ble Apex Court in Lalita Kumari Vs. Government of Uttar Pradesh and others [2014 (2) SCC (1)]. He further submitted that in the aforesaid order, it was further observed that if any cognizable offence is disclosed, the respondent is bound to register a First Information Report, failing which the complaint may be closed in accordance with law. Since the said directions have not been complied with, the present contempt petition has been filed. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that pursuant to the directions of this Court, the respondent Police issued notices to the parties and conducted an enquiry in strict compliance with the principles laid down in Lalita Kumari (supra). He further submitted that immediately upon receipt of the copy of the order passed by this Court, summonses were issued to the petitioner as well as counter parties on 16.03.2023, directing them to appear on 17.03.2023. On 17.03.2023, both parties appeared and upon enquiry, it was found that the dispute between the parties is purely civil in nature. Consequently, the enquiry was closed as 'civil in nature'. He also submitted that the order of this Court dated 06.02.2023 has

been duly complied with and a copy of the closure report has been handed over to the petitioner today. Hence, the respondent Police may be discharged from the contempt proceedings.

Taking into consideration the fact that the final report has been filed and the order of this Court dated 06.02.2023 has been complied with, this Contempt Petition stands closed.
