ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 1 st respondent to renew the passport of the petitioner by processing the application submitted by the petitioner on 06.01.2025. 2.

Heard Mr.P.Kannan Kumar, learned counsel for the petitioner and Mr.S.Dilliraj, learned Central Government Standing Counsel for 1 st respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate [Crl Side] for 2 nd respondent.

It is brought to the notice of this Court that the 1 st respondent has not renewed the passport of the petitioner on the ground that there is a FIR pending against the petitioner in Crime No.137 of 2023 on the file of the 2 nd

respondent.

It is now too well settled that the mere registration of an FIR which is pending investigation, is not a ground for denying the issuance or renewal of passport since it cannot be construed as a case pending. Therefore, the mere registration of the FIR will not be a ground for the 1 st respondent to refuse/ renew the passport.

In the light of the above discussion, there shall be a direction to the st respondent to act upon the application submitted by the petitioner on 06.01.2025 and renew the passport, if the petitioner has satisfied all the other requirements. It is made clear that the FIR that is pending should not be put against the petitioner. This process shall be completed by the 1 st respondent within a period of four weeks from the date of receipt of a copy of this order. 6.

This writ petition is disposed of with the above directions. No costs.
