Common Prayer: These Writ Petitions filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to transfer the petitioner back to the parent unit, namely, Pallavaram Municipality and post the petitioner as a Secondary Grade Teacher in the vacancies at Primary School, Jamin Pallavaram, and Asthinapuram, Pallavaram Municipality, Kancheepuram District as per the Condition No.7 and 8 of the proceedings of the District Elementary Educational Officer, made in proceedings Na.Ka.No.1690/A5/2012 dated 28.07.2012. For Petitioners: Mr.R.Saseetharan in all WPs For R1 to R3 : Mr.C.Munusamy, Spl.GP in all WPs COMMON ORDER The prayer made in these writ petitions is to direct the respondents to transfer the petitioners to their parent unit i.e., Pallavaram Municipality, as per Condition Nos.7 and 8 of https://hcservices.ecourts.gov.in/hcservices/
the proceedings of the District Elementary Educational Officer, bearing Na.Ka.No.1690/A5/2012 dated 28.07.2012. 2.Upon notice, the third respondent filed a counter affidavit meeting the averments made in the affidavits filed in support of these writ petitions. It is pointed out therein that surplus posts and teachers in 'A' unit were deployed to Jamin Pallavaram Municipality School and Asthinapuram Municipality School, which are also coming under 'A' unit and hence, the transfer of the petitioners, who are in 'B' unit does not arise. 3.However, today, when these matters were taken up for consideration, the learned counsel for the petitioners fairly submitted that due to efflux of time, these writ petitions may be closed, with liberty to the petitioners to approach the authority concerned with fresh representation for appropriate relief.
4.In view of the aforesaid submission made by the learned counsel for the petitioners, these writ petitions stand closed, granting such liberty to the petitioners. No costs. Consequently, the connected miscellaneous petitions are also closed.
