Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to consider the representation dated 18.06.2018 made by the petitioner for request transfer from Government High School, Ayanthur, Villupuram District to the vacancy place of Government High School, Keelmampattu, Villupuram District. ORDER
The case of the petitioner is that while she was working as Head Mistress of Government Girls High School, Sithilingamadam Village, Villupuram District, she has been transferred to Headmistress of Ayanthur Government High School, Villupuram District which is 55kms away from her residence. The grievance now expressed by the petitioner is that she being a widow, she has to look after her family and in this regard, the petitioner made a representation dated 18.06.2018 to transfer her against the available vacancies in Government High School, Keelmampattu, Villupuram District. Since no order has been passed by the respondent on such representation, the petitioner has come forward to file this writ petition seeking a direction to the respondent to take a decision on such representation. https://hcservices.ecourts.gov.in/hcservices/
The learned counsel appearing for the petitioner submits that the 1st respondent be directed to pass order on his representation within a stipulated period.
The learned counsel appearing for the respondents would submit that the petitioner has no case, inasmuch as no vacancy is available and she was not eligible for transfer counseling in the current year and hence, prays for dismissal of this writ petition.
Be that as it may, considering the facts and submissions especially the fact that the petitioner's representation is pending, this Court dispose of this writ petition without the counter affidavit of the respondents, with a direction to the 2nd respondent to pass order on such representation in the manner known to law within a period of two weeks from the date of receipt of copy of this order. 5 With the above direction, the writ petition stands disposed of. No costs.
