Prayer: This Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Declaration, declaring that the G.O.Ms.No.363 dated 23.08.2013 passed by the 1st respondent is null and void and not accordance with the order of the Supreme Court passed in Civil Appeal Nos.8848-8840 of 2012 and directed the Respondent to sanction the payment of gratuity to the pensioners for the difference of pension as per Fifth Tamil Nadu Pay Commission of scales of Pay as per the orders of the Apex Court dated 14.08.2013 in Civil Appeal No.6770 of 2013. ORDER

This Writ Petition has been filed challenging the orders issued by Government vide G.O.Ms.No.363 dated 23.08.2013, alleging that the said order was not passed in terms of the order passed by the Hon'ble Supreme Court in Civil Appeal Nos.8848 & 8849 of 2012 etc.

2. When the matter is taken up for consideration, it is brought to the notice of this Court by the learned counsel on either side that similar writ petition has been filed seeking an identical relief was dismissed by a learned single Judge of this Court and the same is also confirmed by a Division Bench of this Court by the judgement dated 14.06.2024 in W.A.Nos.2712, 2713 and 1518 of 2021.
