ORDER
The instant Writ Petition is filed seeking for issuance of a Writ of Mandamus, directing the second respondent to consider and dispose of the appeal preferred by the petitioner dated 21.12.2023.
2. Mr.C.Selvaraj, learned counsel takes notice for the respondents 1 to
3. By consent of the parties, the main writ petition is taken up for disposal at the time of admission stage itself.
3. The learned counsel for the petitioner would submit that as against the order of recovery dated 05.12.2023, the petitioner preferred an appeal before the second respondent on 21.12.2023, without disposing of the said appeal, the respondents are directly attempting to recover the amount in pursuant to the order dated 05.12.2023.
4. At this juncture, the learned counsel appearing for the respondents 1 to 3 fairly submitted that the appeal has not been filed on 21.12.2023, but it has been filed on 05.02.2024.
5. Though there is a dispute in respect of the date of filing of appeal, the fact remains that the appeal is pending before the respondents.
6. Heard both sides and perused the materials available on record.
7. In view of the above, this Court, without going into the merits of the case, deems it appropriate to direct the respondents to dispose of the appeal and pass orders on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
8. With the above directions, this Writ Petition is disposed of. Consequently, connected Miscellaneous petition is closed. No costs. 18.06.2025 : Yes/No Speaking/non-speaking order mn
