Writ petition is filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the respondents 1 to 3 to remove the mango tree grown on the payment of Door No. Old 27/ New 58 which is under the limits of Corporation and pass orders.

ORDER
This writ petition is filed seeking for a Writ of Mandamus directing the respondents 1 to 3 to remove the mango tree situate on the pavement of old door no.27, new door no.58 and pass appropriate orders.
2. It appears that the petitioner has filed the writ petition for removal of the tree in front of his premises, while the complaint was given for removal of the branches of the tree only and not for removal of the tree as such. Therefore, 2/4
in the absence of the complaint for removal of tree, no direction can be issued to the respondents to remove the tree.
3. In view of the above facts, this petition deserves to be dismissed. Accordingly this petition is dismissed. No costs. However, the petitioner is at liberty to file a fresh complaint to the respondents with regard to removal of tree.
