..Respondents Prayer: This writ petition criminal is filed under Article 226 of Constitution of India, praying to issue a WRIT OF MANDAMUS, directing the first Respondent to provide necessary Police assistance to the Authorised Officer of the petitioner bank, being a public servant performing in lawful duty, to remove the leftover household articles lying in the secured property belonging to the second respondent.

ORDER

This Writ Petition (Criminal) has been filed seeking issuance of a Writ of Mandamus directing the first Respondent to provide necessary Police assistance to the Authorised Officer of the petitioner Bank, being a public servant performing in lawful duty, to remove the leftover household articles lying in the secured property belonging to the second respondent.

2. This Writ Petition (Criminal) is disposed of at the time of admission itself with the consent of the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the first respondent and the learned counsel appearing for the second respondent.

3. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the first respondent submitted that the request made by the petitioner would be duly considered in accordance with law.

4. In view of the submissions made by the learned Government Advocate (Criminal Side) appearing for the first respondent, this Court, without expressing any opinion on the merits of the case, deems it appropriate to direct both the petitioner and the second respondent to appear before the first

respondent / respondent police on 03.06.2026 at 11.00 A.M. along with all relevant and required documents in support of their respective claims. Upon such appearance, the first respondent is directed to take into consideration all relevant records, documents and materials that may be produced by the respective parties, conduct necessary enquiry, if required, and thereafter pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

5. With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
