Second Appeal is filed under Section 100 of the Civil Procedure Code, to set aside the Judgment and decree of the learned Subordinate Judge, Sangagiri in A.S.Nos.79 & 80 of 1998 dated 04.04.2001 confirming the Judgment and Decree of the learned District Munsif, Tiruchengode, in O.S.Nos.902/1985 & 504/1993 dated 22.06.1998.
For Appellants : Mr.V. Raghavan C O M M O N J U D G M E N T Learned counsel for the appellants submitted that the matter is settled between the parties out of court and he has also filed a copy of the memorandum of understanding entered into between the parties. He seeks permission of this court to withdraw the appeal since it has become infructuous and he has also made an endorsement to that effect.
