ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.05.2026 for the alleged offences under Sections 309 (4) and 311 of BNS, in Crime No.75 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner snatched gold chain of the defacto-complainant weighing 5 sovereign. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 13.05.2026. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and strongly opposed the bail application on the ground that still recovery is yet to be effected, as only a part of the gold jewelry has been recovered and A1 is still absconding. 5.From the submission of the learned Government Advocate, it is clear that A1 is absconding and the investigation is in its preliminary stage. Hence, this Court is of the firm view that it is premature to consider this bail application. Consequently, this Criminal Original Petition is dismissed. 04-06-2026 ep
