Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondents to dispose of the representation made on 26.11.2019 and 10.07.2020 by the petitioner.

O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents to act upon the representation made by the petitioner dated 26.11.2019 wherein the petitioner is seeking for cancellation of patta issued in favour of the respondents 5 to 9.

2. Mr.E.Balamurugan, learned Special Government Pleader, appearing on behalf of respondents 1,2,3 and 10 submitted that the first respondent has called the parties for preliminary enquiry on 18.12.2020 at 11.30 A.M. The learned counsel further submitted that the petitioner can be present along with all the relevant documents. The learned counsel further submitted that the first respondent will conduct a preliminary enquiry and submit a report before the 4th respondent and the 4th respondent thereafter will pass orders in accordance with law.

3. Taking into consideration the facts and circumstances of the case and also of the fact that the first respondent has already called the parties for an enquiry, there shall be a direction to the first respondent to conduct an enquiry after giving opportunity to the petitioner and the respondents 5 to 9 and shall submit a report before the 4th respondent within a period of six week from the date of receipt of a copy of this order. The 4th respondent, on receipt of the report, shall pass final orders strictly in accordance with law, within a period of four weeks thereafter.

4. This Writ Petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is also closed.
