ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.04.2026 for the alleged offence under Section 194 of BNSS @ 103(1), 238(a) of BNS in Crime No.82 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused committed the murder of the deceased and threw the body into the lake. Hence, this case.

3. The learned counsel for the petitioner submitted that the there are totally three accused. The petitioners herein are arrayed as A-1 and A-2. He further submitted that the petitioners have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are in custody since 28.04.2026 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution's case and, upon instructions, submitted that the investigation is at preliminary stage.

5. I have considered the submissions made on both sides and also perused the records available.

6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); Considering

the totality of the circumstances, and upon the fact that the investigation is at preliminary stage, this Court is of the firm view that it is not appropriate to enlarge the petitioner on bail at this stage.
