O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, directing the fourth respondent to cancel the patta issued by the respondent 3 & 4 in Patta No.671 in Survey No.313/2B, Kazumangalam Village, Nagazkuzhi Madura, Ariyalur District and further give the direction directing the 3rd and 4th respondents to issue the patta on the basis of the parent title deeds and documents standing in the name of the petitioner.

2. The petitioner, without challenging the patta issued in favour of the fifth respondent, cannot seek direction as prayed for, in this Writ Petition. Therefore, this Writ Petition is devoid of merits.

3. In fine, this Writ Petition is dismissed. However, the petitioner is at liberty to challenge the patta issued in favour of the fifth respondent in the manner known to law before the Appellate Authority as contemplated under the Tamil Nadu Patta Pass Book Act. Consequently, the connected Miscellaneous Petition is closed. No costs.
