The petitioner herein is the defacto complainant in the matter which is pending trial before the V Metropolitan Magistrate, Egmore, Chennai in C.C.No.4791 of 2021. The petitioner is before this Court as Party-in-Person alleging that since 26.02.2022, there is no progress in the trial. Though she is in the witness box the examination not yet completed for one reason or another.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that after dismissal of the quash petition filed by the Accused 1 and 2 on 22.07.2022, the examination of witnesses commenced, but due to various reasons examination of PW.1 not yet completed and he submits that the matter is posted on 31.07.2024 for continuation of PW.1 chief.

The status report of the case from 13.10.2021 furnished by the petitioner would indicate that the reason for not completing the examination of PW.1 is not satisfactory. The trial Court ought to have proceeded with the trial without adjourning the matter unnecessarily. 4.

Therefore, this Criminal Original Petition is disposed of with 2/4

the direction to the V Metropolitan Magistrate, Egmore, Chennai to complete the trial within a period of three months from 31.07.2024. On 31.07.2024, the petitioner shall appear before the Magistrate and subject herself for further examination.
