ORDER

The petitioner who is the retired Head Master of Government Adidravidar Welfare Elementary School has filed this writ of Certiorari to call for the records relating to the 1st respondent impugned notice dated 04.09.2014 in Na.Ka.No.14390/2014/K2 and to quash the same.

2. The petitioner was working as a Head Master in the Government Adidravidar Welfare Elementary School at Vettiyakadu Village, Vedarnyam Taluk in the year 2014. The first respondent issued impugned notice, called upon him to pay the dues a sum of Rs.3,91,765/- as if he availed the loan from the 2nd respondent. He never borrowed any loan from the second respondent. Hence this writ petition.

3. Heard Mr.S.Arivazhagan, learned counsel for the petitioner, Mr.S.John J.Raja Singh, learned Additional Government Pleader for the first respondent and Ms.P.Rajalakshmi, learned counsel for the second respondent.

4. Ms.P.Rajalakhsmi, learned counsel for the second respondent submits that the petitioner did not avail any loan from the second Page No.2/4

respondent and the impugned notice was mistakenly sent to the petitioner. The learned counsel would further submit that in fact, the petitioner availed a loan from Vedaranyam Taluk Government Staff Cooperative Thrift Society for an amount of Rs.2,00,000/- in loan No.1040 dated 29.03.2007 and the loan was paid in full on 19.03.2019.

5. Recording the same, this Writ Petition stands allowed and the impugned Notice dated 04.09.2014 issued by the first respondent stands quashed. No costs. Consequently, connected Miscellaneous Petitions, if any, are also closed.
