The petitioner, who was arrested and remanded to judicial custody on 14.05.2022 for the offences punishable under Sections 449 & 302 of IPC and subsequently altered into Sections 147, 148, 449, 427 & 302 of IPC in Crime No.292 of 2012, seeks bail.

2. The case of the prosecution is that, due to previous enmity, the petitioner /A2 along with other accused assaulted the defacto complainant's son using wooden log and stones, due to which, the deceased sustained grievous injuries and died. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case. That apart, the petitioner has been suffering incarceration from 14.05.2022. Hence, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that Goondas proposal is pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner and also considering that there is a goondas proposal is pending against him, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this criminal original petition is dismissed. 04.08.2022 Sma
