Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 10.10.2015 to release the petitioner's Savings Bank Account No.802110100011407.

O R D E R

The relief sought for in the present writ petition is to direct the respondent to consider the representation submitted by the petitioner on 10.10.2015.

2. The petitioner states that her husband Mr.M.Chandrasekaran was an employee of Integral Coach Factory (ICF), employed as Junior Engineer (Employee I.D.No.461747) and got retired from service on 18.11.2000.

3. The husband of the petitioner died on 07.06.2004. Thereafter, the petitioner was receiving the family pension of her husband. The petitioner was continuously receiving the family pension and it is contended that the respondent has suddenly stopped the family pension, without any notice. Thus, the petitioner is constrained to move the present writ petition. https://hcservices.ecourts.gov.in/hcservices/

Admittedly, the husband of the petitioner was a retired employee of the Integral Coach Factory of the Indian Railways, which is notified under the Administrative Tribunals Act and therefore, in respect of grievances relating to pension or family pension, the same is to be adjudicated before the Central Administrative Tribunal, Chennai Bench.

5. Further, the petitioner has to approach the Competent Authority of the Integral Coach Factory and the respondent-Bank is only a Disbursing Authority and the petitioner has to ascertain whether there is any order passed by the Integral Coach Factory or not. Such factors are to be ascertained and in the event of any such grievances relating to the family pension sanctioned by the Railway Department, then the petitioner has to approach the Competent Forum.

6. With this liberty, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
