To confirm the public auction of Sl. Nos.1, 2, 3, 5, 7, 8, 9, 10 and 11 in favour of the highest bidders for the properties with a direction to the highest bidders to pay 3 months of security deposit and 7 months of caution deposit amount within fifteen days from the date of order and thereafter execute lease/rental agreement in their favour for a period of 30 years with lease amount increasing by 15% every three years. 1/5

Though an auction was held for Door Nos. 9 and 10 of Mohandoss Lane in Royapettah, measuring about 720 and 744 Sq. feet respectively, during inspection it was discovered that a land of an extent of 1372 Sq. feet lies immediately on the western side of the Door Nos.9 and 10 also belongs to the same trust and it is covered by the same patta. The access to that excess land of 1372 Sq.feet is through a three feet lane from Pycrafts Road First Street. If access is provided to the said land from Mohandoss Lane through Door Nos.9 and 10, it will fetch a higher price. Therefore, the learned Administrator General and Official Trustee had negotiated with the successful bidders of Door Nos.9 and 10 and required them to take the remaining land of 1372 sq. feet also. This offer was not accepted by one of the bidders viz. Mr.Yusuf Galaria. He has withdrawn his offer also. The other highest bidder, Mr.Mohamed Rasul, had offered to take the land of an extent of 1372 sq. feet also along with the extent of 1464 sq. feet, totalling to 2836 sq. feet for a monthly rent of 1,05,000/-. 2/5
2. The Additional Report of the learned Administrator General and Official Trustee shows that the offer of Mr.Mohamed Rasul is reasonable, considering the location and the accessibility of the property.

In view of the same, the learned Administrator General and Official Trustee is permitted to lease the said property measuring 2,836 sq. feet to Mr. Mohamed Rasul, at a rent of Rs.1,05,000/- per month for a period of 30 years subject to the condition relating to periodical increase in rent as per the auction Notification.
4. The auction of the land in Sl. Nos.1, 5, 7, 8, 9, 10 and 11 are confirmed as per the offers made by the respective highest bidders. 5.. This petition is ordered accordingly.
