J U D G M E N T

This Civil Miscellaneous Appeal is filed against the judgment and decree dated 01.04.2011 and made in MCOP.No.1097 of 2008 on the file of the Motor Vehicle Accidents Claims Tribunal, Principal District Court, Krishnagiri.

2. Today, when the matter is taken up consideration, it is represented by the learned counsel for the appellant that the entire compensation was deposited by the appellant and the same was withdrawn by the claimants before granting an order of interim stay by this Court. It is further represented that the matter was already settled before the High Court Lok Adalat 22.09.2012. Therefore, nothing survives for adjudication in the present appeal and hence, the appeal may be dismissed as infructuous.

3. In view of the submission made by the learned counsel for the appellant/Insurance Company, this Civil Miscellaneous Appeal is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is also closed.
