Order The present applications have been filed to recall the order dated 30.04.2021 passed in A Nos.1219, 1225 and 1224 of 2021 and to restore the said applications.

This Court passed an order on 30.04.2021 as follows :-

On perusal of the report submitted by the learned AG & OT, it is evident that the income received from the various Trust Estates administered by the learned AG & OT is grossly insufficient to pay salary on par with the Office Assistant or Junior Assistant in Government Service. It is evident that the salary or conveyance is payable to the Estate Clerks or Office Boys only from and out of the income generated or derived from the properties of the respective Trust Estates. References were also made by the learned AG & OT that the income derived from some of the trust properties are very low and therefore out of such meagre income, salary could not be paid to the Estate Clerks or Office Boys on par with the Office Assistant or Junior Assistants in Government Service.

In the report, certain instances were quoted to show that the salary payable to the Estate Clerks or Office Boys is over and above the income derived from the properties of the respective Trust Estates.

On the contrary, the salary and other allowances payable to the employees employed by the AG & OT overshoots the income and therefore, it is just and necessary to recall the earlier order dated 20.12.1995 passed in Application Nos. 6621 and 6622 of 1995 in OP No. 109 of 1943.

11. As regards the fixation of enhanced consolidated pay to the Estate Clerks Mrs. S. Malini and Mrs. S. Jayanthimala as also in favour of Mr.R. Kulanchinathan, Office Boy upon their expressed willingness to forgo Pension, DCRG etc., on their retirement, this Court finds that the enhanced pay proposed by the learned AG & OT is just and reasonable.

The learned Additional Government Official Trustee (AG&OT) submitted that the employees were initially engaged on a consolidated basis and that the directions of this Court fixing Government pay scales to these estate employees are not in consonance with the service conditions of the estate employees. These employees are not Government servants but are engaged to manage the estate vested with the AG&OT. This AG&OT is empowered to fix their salary considering the nature of work and work load involved. The fixation of Government salary to these employees result in causing financial loss to the estate and therefore, the order is liable to be recalled and the matter has to be reconsidered afresh.

In view of the said submissions, this Court is inclined to reconsider

the issues involved since the Government pay scales are not directly applicable to the employees engaged by the AG&OT to maintain the estate vested with the AG&OT. Accordingly, the order passed by this court in Application Nos. 1219, 1225 and 1224 of 2021 is recalled and the said applications are restored and directed to be listed for fresh consideration on 03.07.2026. 19-06-2026 Index: Yes/No Speaking/Non-speaking order RKA To
