ORDER
This writ petition has been filed seeking direction to the first respondent to initiate appropriate action against the second respondent to release the originals of the petitioner viz., SSLC Marksheet, 12th Marksheet, Community Certificate, Transfer Certificate.
2.When the matter is take up for hearing today, the learned counsel for the petitioner submitted that the petitioner has received all the certificates from the second respondent, https://hcservices.ecourts.gov.in/hcservices/
therefore, the matter has become infructuous. 3.On 20.01.2022, this Court directed the second respondent to appear before this Court on 25.01.2022. Since the order was not complied with, this Court issued Non-Bailable Warrant (NBW) against Mr.Narayanan, who represents the second respondent. Today, the concerned Police and Mr.N.Muthuvel, Government Advocate (Crl.Side) appeared before this Court and submitted that the said Narayanan is 85 years old and now, he is hospitalised, therefore, he could not appear before this Court. 4.As the prayer has become infructuous, this Court is of the view that, it would be appropriate to recall the warrant considering the health condition of the said Narayanan, representing the second respondent. Accordingly, the NonBailable Warrant (NBW) issued against the said Narayanan is hereby recalled.
5.With the above observation, this Writ Petition is dismissed as infructuous. No Costs.
