..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 1st respondent to grant approval of the layout as promoted by the petitioner SF.No.19/3 Ward-A, Block-13, TS.No.20/30 of Ammapalayam Village, Salem District to an extent of 0.75 1⁄2 acre by considering the application submitted by the petitioner herein dated 27.03.2023 and the proceedings of the Director of District Town and Country Planning, Salem in ROC.NO.SLM/SWC2785E/9657/2023/2022/TCP dated 25.03.2023 within the time fixed by this Court in the light of the judgment dated 20.10.2023 passed in SA.No.819 of 2006. ORDER

This writ petition has been filed to direct the first respondent to consider the petitioner's application dated 27.03.2023.

2. The learned counsel for the petitioner would submit that in this case, the petitioner has given an application dated 27.03.2023 to grant approval of the layout as promoted by the petitioner SF.No.19/3 Ward-A, Block-13, TS.No.20/30 of Ammapalayam Village, Salem District to an extent of 0.75 1⁄2 acre by considering the proceedings of the Director of District Town and Country Planning, Salem in ROC.NO.SLM/SWC2785E/9657/2023/2022/TCP dated 25.03.2023 and in the light of the judgment dated 20.10.2023 passed in SA.No.819 of 2006. However, the said application was not at all considered by the first respondent, till date. Hence, this petition.

3. In reply, the learned standing counsel appearing for the first respondent would submit that the petitioner's application dated 27.03.2023 will be disposed of by the first respondent within a period of 12 weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In view of the above, without expressing any opinion on the merits of the case, this Court directs the first respondent to consider the petitioner's application dated 27.03.2023 and dispose of the same, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No cost.
