PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus, directing the 1st respondent to provide with police protection while survey and fixing the boundary of the property of the petitioner comprised in SF. No. 333/1A and 333/1D at Sankaramanallur North, Madathukulam Taluk, Thiruppur District by Taluk Surveyor, Madathukulam by considering the representation of the petitioner herein dated 21.06.2024. ORDER

This Writ Petition has been filed seeking a direction to the first respondent to provide police protection to survey and fix the boundary of the petitioner's property comprised in S.F.No.333/1A and 333/1D situated at Sankaramanallur North, Madathukulam Taluk, Thiruppur District.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned property comprised in S.F.No.333/1A and 333/1D situated at Sankaramanallur North, Madathukulam Taluk, Thiruppur District. While being so, the second respondent obstructed the petitioner from using the pathway. Therefore, the petitioner applied for a survey of his land before the Revenue Authorities on payment of requisite fees. While the surveryor proceeded to survey the petitioner's land, the second respondent obstructed the same.

4. In view of the above, if the surveyor finds any hindrance while surveying the petitioner's property, the surveyor can very well seek police protection from the first respondent. On such request, the first respondent is directed to consider the same and pass orders while surveying the petitioners property comprised in S.F.No.333/1A and 333/1D situated at Sankaramanallur North, Madathukulam Taluk, Thiruppur District.

5. With the above direction, this Writ Petition stands disposed of. No costs.
