Prayer: Criminal Original Petition filed under Section 438 of Criminal Procedure Code to enlarge the petitioner on bail in the event of arrest in connection with Crime No.304 of 2020 pending on the file of the respondent police.

(The case has been heard through Video Conference) Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent.
2. This is the second petition filed seeking anticipatory bail for the offences punishable under Sections 21(1) of Mines and Minerals Act (Development and Regulation Act) r/w 379 of IPC.457 and 380 of IPC in Crime No.304 of 2020 on the file of the respondent police.
3. The earlier petition filed by the petitioner was dismissed by this Court on recording the statement of the learned Additional Public Prosecutor that out of five accused, three were arrested and this petitioner and another are absconding.
4. Learned counsel for the petitioner in the second anticipatory bail petition stated that one of the accused was already granted bail. Therefore, it is the change of circumstances to entertain the second anticipatory bail in respect of the absconding accused. 2/4
5. This court finds no sufficient reason or change of circumstances to revisit the order. The second anticipatory bail petition is dismissed in view of the fact that the stolen property were not recovered till date.
