PRAYER:

Petition filed under Article 226 of the Constitution of India praying to issue a writ of Certiorarified Mandamus to call for the records on the file of the first respondent with regard to the order passed in their proceedings in (1) letter No.23782/B2/2013-3 dated 27.09.2013 and (2) letter No.38800/B1/2013-1 dated 05.12.2013 and quash the same and direct the respondents to relieve the petitioner from service on Voluntary Retirement with effect from the afternoon of 30.09.2013 construing that his service is no more comes under the category of rare speciality in clinical side as stated in the Government Order in G.O.Ms.No.408 Health and Family Welfare (B2) Department dated 15.12.2009 with all monetary and service benefits.

ORDER

Today, when the matter is taken up for hearing, the learned counsel for the petitioner would submit that the matter relates to the request made by the petitioner seeking Voluntary Retirement from service. Subsequently, the learned counsel for the petitioner would submit that the petitioner's application is likely to be considered by the first respondent. Therefore, he seeks permission of this Court to Withdraw the present writ petition.

2. In view of the submissions made by the learned counsel for the petitioner, this writ petition stands dismissed as withdrawn. No costs. Consequently, the connected miscellaneous petition stands closed.
