ORDER

Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents 1 to 3.

Issuance of notice to the private respondents is dispensed with. 3.

The petitioner states that she was issued with an assignment order in the year 2008. However, the private respondents have moved the Revenue

Divisional Officer, Nallampalli Taluk, Dharmapuri, for cancelling the petitioner's patta. In the meanwhile, the petitioner has filed O.S.No.532 of 2025 on the file of the Additional Subordinate Court, Dharmapuri, seeking the relief of declaration and permanent injunction. The Revenue Divisional Officer is very much a party to the suit proceedings. It is for the petitioner to obtain an interim order before the Civil Court. When the petitioner has already invoked the common law remedy, she cannot maintain parallel writ proceedings. However, taking into account that a comprehensive suit has been filed, I restrain the second respondent from passing any final order in the enquiry for a period of eight weeks from the date of receipt of a copy of this order. It is for the petitioner to obtain an interim order in her favour in the pending suit.

If within eight weeks, the petitioner is unable to get an interim order in the Civil Court, it is open for the second respondent to proceed in the manner known to law. This writ petition is disposed of accordingly. I make it clear that I have not gone into the merits of the matter. The contentions of the private respondents have not been foreclosed. No costs. Connected W.M.P. is closed.
