Mr.N.Srinivasan, Addl.Govt.Pleader - for R2 Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamu directing the second respondent to recover the interest amount of Rs.52,966/- from the first respondent and the same may be remited in the office of the controlling authority under the Payment of Gratuity Act, 1972-cum-Assistant Commissioner of Labour (Gratuity), Coimbatore.

O R D E R

This writ petition is filed seeking direction to the second respondent to recover the interest amount of Rs.52,966/- towards interest due on the gratuity, from the first respondent by invoking the provisions of Revenue Recovery Act and to remit the amount in the office of the controlling authority under the Payment of Gratuity Act, 1972-cum-Assistant Commissioner of Labour (Gratuity), Coimbatore.

2. Learned counsel appearing for the second respondent would submit that whatever is legally possible, the second respondent would take earnest steps to invoke the provisions of Revenue https://hcservices.ecourts.gov.in/hcservices/

Recovery Act within the time prescribed by this Court.

3. Under the circumstances, the second respondent is directed to initiate the proceedings under the Revenue Recovery Act to recover the interest amount of Rs.52,966/- towards interest due on the gratuity, from the first respondent and complete the same within a period of four weeks from the date of receipt of a copy of this order. With this direction, the writ petition is disposed of. No costs.
