When the matter was taken up for hearing today, it was brought to the notice of this Court that the issue that is involved in the present writ petition is squarely covered by the order dated 05.06.2025 passed by a learned Single Judge in W.P.No.33079 of 2024 etc. batch.
2. The learned counsel for the petitioner submitted that certain issues which were raised before the learned Single Judge were not considered and therefore, this Court can independently deal with this writ petition.
3. In the considered view of this Court, the order that has been passed by the learned Single Judge is going to be subjected to appeal and therefore, no useful 2/4
purpose will be served if a Division Bench and also a Single Bench consider the issue independently as it will lead to unnecessary confusion. Now that appeals are going to be filed against the order passed by the learned single Judge in the aforesaid batch of cases, it will be more appropriate, if the issue is dealt with by a Division Bench instead of a learned Single Judge going into the same issues all over again. This will ensure judicial discipline.
4. In view of the above, this writ petition stands disposed of in terms of the order dated 05.06.2025 passed in W.P.No.33079 of 2024 etc. batch. No costs. Connected W.M.P. is closed.
