Prayer : Criminal Original Petition filed under Section 439 (1) (b) of Cr.P.C., to modify the condition of the Judicial Magistrate No.I, Villupuram, order made in C.M.P.No.1431 of 2020, dated 19.09.2020 (2) the petitioner shall deposit a title deed in his favour of his spouse of value not less than Rs.25,00,000/- (Rupees Twenty Five Lakhs Only).

(3) the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakhs Only) before this Court to the credit of above said Crime Number.

ORDER

(This case has been heard through video conference) The petitioner, arrested in Crime No.27 of 2020 by the respondent police for the alleged offence punishable under Section 420 of IPC, and granted bail by the lower Court in C.M.P.No.1431 of 2020 on 19.09.2020 with certain conditions, seeks modification of Condition Nos.2 and 3.

2.The petitioner was granted bail by the lower Court on 19.09.2020 with certain conditions. Of the other conditions, condition No.2 is that the petitioner shall deposit title deeds. The petitioner submits that the petitioner, either through his relatives or his friend who have got property value worth about Rs.25,00,000/- (Rupees Twenty Five Lakhs Only) will stand as surety to comply with the condition. Due to non compliance of the condition, the petitioner despite obtaining the bail during the month of September, he is still in custody. The petitioner undertakes to make arrangements through his relatives or friends to 2/5

execute sureties who will also file an affidavit while depositing title deeds in favour of the petitioner. The other condition imposed on the petitioner is to deposit Rs.1,00,000/-. But the petitioner is unable to make cash deposit of Rs.1,00,000/- and he shall deposit a sum of Rs.50,000/- before this Court to the credit of above said Crime Number. The petitioner submits that he is now transferred from District Jail, Vellore to Central Jail, Cuddalore.

3.The Petition is allowed to the extent of modifying the condition.

(i) The relatives or the friends of the petitioner shall deposit title deed of property value worth about Rs.25,00,00/- (Rupees Twenty Five Lakhs Only) (ii) The petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand Only) to the credit of Crime No.27 of 2020. 02.12.2020 gbi Note: Issue Order Copy on 04.12.2020.
