Heard Thiru.P.Ganesan, learned counsel for the petitioner and Tmt.Raniselvam, Additional Government Pleader, for the respondents.
2. With the consent of both the sides, the Writ Petition is taken up for disposal.
3. The petitioner has come up with this Writ Petition seeking for a Writ of Mandamus to direct the respondents to consider and appoint him as a cook, by taking note of representations dated 4.12.2015 and 16.4.2016. The petitioner claims for such appointment by contending that cook is coming under the basic service rules and as per rules, cook posts will https://hcservices.ecourts.gov.in/hcservices/
be filled by direct recruitment or recruitment by transfer from any other service or transfer from any other category in Class IV and V; that sweeper post is Category 12 in Class IV and therefore, the petitioner states that he is entitled to be appointed by recruitment by transfer to the post of cook. Notification for recruitment has been issued and the petitioner has been called for interview. He has also attended the interview.
4. In the light of the above, there will be a direction to the third respondent to consider the petitioner's representation on merits and in accordance with law and thereafter, submit appropriate proposal to the first respondent for further orders. The above direction shall be complied with by the third respondent, within a period of three weeks from the date of receipt of a copy of this order.
