The petitioners were apprehend arrest for the alleged offence under Sections 4(1)(C) and 4(1)(h) of TNP Act, in Crime No.208 of 2025 on the file of the respondent police seeks anticipatory bail. 1/4

2. The case of the prosecution is that when the respondent police were on patrol, the petitioners were found in illegal possession of 22 bottles of Brandy (each 180 ml). Hence, the case.

3. The learned counsel appearing for the petitioners submitted that they are innocent persons and have been falsely implicated in this case. He would submit that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police opposed the anticipatory bail on the ground that there are 45 previous cases pending against the first petitioner/A1 and 41 previous cases pending against the second petitioner/A2. She further submitted that if anticipatory bail is granted, it will send a wrong signal to the society.

5. Taking into consideration of the totality of the circumstances and the fact that there are previous criminal antecedents pending against the petitioners, and if anticipatory bail is granted, there is every likelihood that 2/4

the petitioners would commit similar kind of offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
