ORDER

The petitioner has come forward with the above Writ Petition praying for issuance of a Writ of Mandamus to direct the respondent to consider the application, dated 06.04.2018 submitted by the petitioner and grant approval to the petitioner to increase the intake by 80 seats in two courses already offered by the petitioner, viz., the 'Pre-Sea Training for GP

Ratings' and 'Diploma in Nautical Science' courses and begin a new course called 'Pre-Sea I-Year Training for Graduate Engineers' with an intake of 80 seats.

2. The petitioner-institution was established in the year 2000 with the aim of imparting maritime education and training on par with international standards. The petitioner-institution decided to increase the intake of two courses offered by them, namely Pre-Sea Training for GP Ratings and Diploma in Nautical Science, by 80 seats and to begin a new course, called 'Pre-Sea 1-year Training for Graduate Engineers' with an intake of 80 seats. Hence, the petitioner submitted application dated 06.04.2018 to the respondent for necessary approval of the said courses. Since the said application is still pending, the petitioner has filed the present Writ Petition for the abovesaid relief.

3. When the Writ Petition is taken up for hearing, learned Central Government Standing Counsel appearing for the respondent submitted that the respondent has no objection for considering the said application, dated 06.04.2018 in accordance with law.

4. Accordingly, without going into the merits of the case, the respondent is directed to consider the said application of the petitioner, dated 06.04.2018 and after hearing the petitioner and others who are likely to be affected, pass appropriate orders on merits and in accordance with law, on or before 27.07.2018, if there is no legal impediment for considering the same.
