Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to accept application of the petitioner to take part in the recruitment process 1/4

initiated vide Notification No.12390/Nir5(1)/2014 dated 26.10.2015 without reference to the amendment to the general rules in part II of the Tamil Nadu State and Subordinate Service Rules (Vol.I of the Tamil Nadu Services Manual 1987) vide Rule 54(B) vide G.O.Ms.No.114 dated 11.08.2010 and consequently without reference to clause 2 of the Notification of the second respondent so far as the petitioner is concerned direct the respondents to implement G.O.Ms.No.98, Personnel and Administrative Reforms Department, dated 17.07.2006 by increasing the upper age limit of MBC and BC candidates from 32 to 40 years.

O R D E R

The relief sought for in the present writ petition is to direct the respondents to accept the application of the petitioner to take part in the recruitment process initiated vide Recruitment Notification dated 26.10.2015 without reference to the amendment to the Special Rules regarding the upper age limit.

Even at the time of filing of the present writ petition, the petitioner was aged about 39 years and now he would be around 42 years, the petitioner was not permitted to participate in the process of selection, since he was over aged during the relevant point of time when the Recruitment Notification was issued in the year 2015.

3. Thus at this length of time, the relief as such sought for in the present writ petition lost its relevance and further the selection process had been already concluded in respect of Recruitment Notification dated 26.10.2015. Hence, no further consideration is required in respect of the grounds raised in the present writ petition.

4. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. The connected miscellaneous petition is also dismissed.
