Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehend arrest for the alleged offence under Section 341, 294(b), 323, 397 and 506(ii) of IPC in Crime No.575 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant viz., Madan, who is Horseman by profession in Marina Beach with knife point and snatched a sum of Rs.150/-. Hence the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submits that there are two previous cases against the petitioner, out of which, one is filed under Section 307 IPC and another one is filed under Section 506(ii) IPC. He further submits that the petitioner is a History Sheeter. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and considering the submissions made by both counsel and also the fact that there are two previous cases against the petitioner, this court is not inclined to accede to the prayer as sought for by the petitioner.

6. Accordingly, the anticipatory bail sought for cannot be granted and this petition is dismissed.
