O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the 1 st respondent not to impound the passport of the petitioner and to renew the passport, based on the application submitted by the petitioner.

2. Heard both sides and perused the materials placed on record.

3. It is brought to the notice of this Court that an FIR came to be registered against the petitioner by the 2 nd respondent in crime No.1/2020. On completion of investigation, police report has been filed before the Additional Mahila Court, Tiruchirapalli and it has been taken on file in C.C.No.1146/2020 and the same is pending. In the meantime, a notice came to be issued by the 1 st respondent dated 25.11.2024 for impounding the passport of the petitioner. The petitioner also made an application seeking for renewal of the passport. The same was not considered and hence, the present writ petition has been filed before this Court.

4. In the considered view of this Court, there is a case pending against the petitioner before the Additional Mahila Court, Tiruchirapalli, in C.C.No. 1146/2020. Hence, if the passport has to be renewed, the petitioner has to file an 2/4

appropriate application before the Court concerned and based on the orders passed by the Court, the same can be placed before the 1 st respondent and the st respondent will act upon the same.

5. In the result, the petitioner is given the liberty to file an application before the Additional Mahila Court, Tiruchirapalli, in C.C.No.1146/2020 for permission to renew the passport. This application shall be dealt with by the Court concerned and an order shall be passed within a period of two weeks from the date of receipt of the application from the petitioner. Based on the orders passed by the Court, the st respondent shall act upon the same while considering the application for renewal of passport.

This writ petition is disposed of on the above terms. No costs. 11.06.2025 Index : Yes/No gya 3/4
