Crl.O.P.Nos.15108 & 15065 of 2023 G.CHANDRASEKHARAN.J., The petitioners in both Crl.O.P's namely Elaiyanambi & Elumalai, who were arrested and remanded to judicial custody on 22.05.2023 registered for the offences punishable under Sections 120B, 328, 304(1) of IPC read with Section 7(a), 4(1)(1), 4(1-A)(i) of TN Prohibition Act, 1937 and subsequently altered into Sections 304(2), 302, 120 B, 328 IPC and Section 4(1-A)(ii), 4(1)(1), 7(a), 4(1-A)(i), 14(A), 4(1)(aaa) of TNP Act and Section 7 of Tamil Nadu Denatured Spirit, Methyl Alcohol and Varnish (French Polish) Rules, 1959 in Crime No.6 of 2023 on the file of the respondent police seeks bail.

2. When these matters are taken up for hearing, learned Government Advocate (Crl. Side ) submitted that, petitioners are detained under Goondas Act.

3. In the light of the submission made by the learned Government Advocate (Crl. Side) that petitioners are detained under Goondas Act, these Criminal Original Petitions are dismissed giving liberty to the petitioners to file a fresh petition after the detention order is revoked against them.
