O R D E R

This Writ Petition has been filed to direct the respondents to issue an appointment order to the petitioner as a secondary grade teacher based on the compassionate ground.

2. According to the petitioner, she made an application in the year 2013 before the District Collector, Nagappattinam and also made another application dated 20.05.2014 before the Educational Authority, namely, District Educational Officer requesting the respondents to appoint her in anyone of the post as a secondary grade teacher based on the compassionate ground for the death of the petitioner's father. The father of the petitioner died on 22.03.2013. The said applications are still pending and no orders have been passed.

3. The learned Government Advocate would submit that the petitioner's application dated 20.05.2014, would be considered on the basis of the available vacancy in the Department and the same will be considered within the time frame fixed by this Court.

4. Without expressing any opinion on merits, this Court is inclined to direct the second respondent to consider the petitioner's application dated 20.05.2014 and pass appropriate orders in the light of the G.O.Ms.No. 165 passed by the Labour and Employment Department dated 30.08.2010, after giving opportunity to the petitioner, as expeditiously as possible within a period of twelve weeks from the date of receipt of a copy of this order. The second respondent shall also consider the necessary approval from the Government Authorities, if any required.

5. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
