.. Respondent in both the appeals Criminal Appeal filed u/s 374 of the Code of Criminal Procedure, against the judgment dated 30.04.2003, passed by the learned Special Judge, Nilgiris @ Uthagamandalam, made in C.C. Nos.8 & 9 of 2001.

For Appellant : Mr. Srirangan For Respondent : Mr. V.Iyyapparaj, APP COMMON JUDGMENT These appeals are directed against the judgment dated 30.04.2003, passed by the learned Special Judge, Nilgiris @ Uthagamandalam, in C.C. Nos.8 & 9 of 2001.

2. This Court, vide order dated 22.1.2018, on being brought to its notice that the appellant had died, for which death certificate was produced, dismissed the appeals as abated. However, at the instance of the legal heirs of the appellant, miscellaneous petitions were filed for the petitioner therein to be impleaded as appellant to pursue the appeals and this Court, vide order dated 3.7.19, https://hcservices.ecourts.gov.in/hcservices/

allowed the petitions and, accordingly, the petitioner therein got impleaded and stood substituted as appellant in these appeals and the appeals are listed before this Court for hearing today.

3. When the appeals are taken up for hearing, learned counsel for the appellant as well as the learned Addl. Public Prosecutor are present. This Court, as well as the counsel and the legal heir of the appellant on either perused the entire materials available on record and, thereafter, it is submitted on behalf of the appellant that the appellant does not wish to pursue the appeals any further.

4. Accordingly, recording the said submission made by the learned counsel for the appellant, these appeals are dismissed as having abated.
