Writ Petition filed under Section 226 of Constitution of India praying for issuance of Writ of Mandamus directing the respondent to pass a considered order on the application given by the petitioner on 11.06.2019 and consequential relief by way of direction directing the respondent to issue patta in favour of the petitioners namely T.Ramachandran and R. Kalamani, bearing Door No.2/8, Plot No.5, Ganga Street, Bharath Nagar, Adambakkam, Chennai 600 088, measuring an extent of 1600 sq.ft. O R D E R

The Tahsildar, Alandur, St.Thomas Mount, Chennai is suo motu added as the 2nd respondent in this Writ Petition.

2. This Writ Petition has been filed for the issue of Writ of Mandamus directing the respondents to consider the representation made by the petitioners, who are seeking for issuance of patta in their favour with respect to the subject property.

3. The learned counsel for the petitioners submitted that after the application was submitted, the 2nd respondent had infact made an inspection of the subject property and thereafter, no steps were taken to pass orders on the ground that the file went missing. The learned counsel submitted that the petitioners will make a fresh online application to the 2nd respondent and the 2nd respondent can be directed to pass appropriate orders within the time limited fixed by this Court.

4. Heard Mr.B.Sekar, learned counsel appearing for the petitioner and Mr.S.N.Parthasarathy, learned Govt. Advocate appearing for the respondents.

5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the petitioners to submit a fresh online application to the 2nd respondent seeking for patta with respect to the subject property. The 2nd respondent immediately, on receipt of the same shall conduct an enquiry and pass appropriate orders strictly in accordance with law within a period of six weeks from the date of receipt of the application from the petitioners. The petitioners are also directed to make an independent representation to the 2nd respondent along with all the relevant documents and also a copy of this order.

6. This Writ Petition is disposed of with the above directions. No costs.
