ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 3rd respondent to forthwith consider and process the Petitioner's Application No.2024/0105/12/525829 dated 30.05.2024, filed for sub-division and patta transfer in favour of the petitioner within a time frame to be fixed by this Court.
3.It is submitted by the learned counsel for petitioner that petitioner is the absolute owner of the property by way of Settlement Deed dated 13.09.2017, registered as Document No.4993/2017 executed by the petitioner's father in favour of petitioner. Pursuant to the above 2/6
Settlement Deed, petitioner continued in possession and enjoyment of the same. It is further submitted that petitioner made application dated 30.05.2024 seeking sub division and transfer of patta in his favour. However, the said application has not been considered by the respondents till date. Aggrieved by the same, petitioner has come before this Court.
4.At the outset, learned Additional Government Pleader for respondents would submit that the application dated 30.05.2024 would be considered and appropriate orders would be passed in accordance with law within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.
5.In view thereof, considering the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the 3rd respondent, to consider the application made by the petitioner on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested party/rival claimants, if any, within a period of eight weeks from the date of receipt of a copy of this order. made clear that this Court has not expressed any views with regard to the merits of the applications and it is open to the concerned respondent to consider the applications on its own merits and in accordance with law. 6.With the above direction, this writ petition stands disposed of. No costs.
