Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records of the Respondent relating to the order in Letter No. 66292/Pay Cell/2015-1 dated 02.02.2016, quash the same insofar as it relates to the Petitioner and issue consequential direction to the Respondent to extend the benefits of G.O. Ms. No. 340, Finance (Pay Cell) Department dated 26.08.2010 to the Petitioner herein from the date of his appointment and disburse the monetary benefits thereof from 01.08.2010 within a time frame. Though the matter has been posted under the caption 'for dismissal', there was no representation for the Petitioner when the matter was called at 10.40 a.m. today, apart from the earlier hearing on 23.08.2022. There does not appear to be any useful purpose being served in keeping the Writ Petition pending indefinitely when the Petitioner is not interested in prosecuting the same.
In such circumstances, the Writ Petition is dismissed for non-prosecution. It is made clear that the Petitioner is not precluded from applying for revival of the Writ Petition, if necessary, in accordance with law. No costs.
