Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the respondent to fix the pay scale for the petitioners in accordance with the orders issued by the Government of Tamilnadu in G.O.Ms.No.451 Finance (Pay Cell) Department dated 31.12.2010 with effect from 01.12.2010 and to pay the arrears of pay therefor with effect from 01.12.2010 and to pay interest on the arrears of pay worked out for every three month at a rate as may be fixed by this Court. This Writ Petition is filed seeking for a direction to the respondent to fix the pay scale for the petitioners in accordance with the orders issued by the 3/6

Government of Tamilnadu in G.O.Ms.No.451 Finance (Pay Cell) Department dated 31.12.2010 with effect from 01.12.2010 and to pay the arrears of pay therefor with effect from 01.12.2010 and to pay interest on the arrears. 2.When the matter is taken up for hearing, learned Additional Government Pleader representing the respondent has submitted that the Government has issued orders fixing the pay of all the petitioners in accordance with G.O.Ms.No.451 Finance (Pay Cell) Department dated 31.12.2010 as sought for by the petitioners. Copies of the proceedings have been circulated to learned counsel for the petitioners. Once the pay of the petitioners has already been fixed as sought for in this Writ Petition, cause does not survive to the petitioners to prosecute this Writ Petition. In view of the above, the Writ Petition will not survive.
