Noorunnisa v. J.Hasan Ali
C.M.P.No.14714 of 2024 in C.M.A.SR.No.82669 of 2024 R. KALAIMATHI, J.
This petition has been filed seeking to condone the delay of 511 days in filing the appeal.
2. Heard the learned counsel for the petitioner.
3. The learned counsel for the second respondent does not have any serious objection in allowing this petition.
4. The first petitioner would aver that due to the sudden demise of her husband, who was the sole bread winner and taking care of the family, she has been struggling to take care of her needs and meet day-to-day expenses. Hence, the delay of 511 days occurred in filing the appeal.
5. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 511 days shall stand waived.
