W.M.P.Nos.19031, 19034 &19036 of 2023 in W.P.No.19896 of 2018 P.B.BALAJI, J., The Writ Miscellaneous Petition in W.M.P.No.19036 of 2023 has been filed to dispense with the production of the order Se.Mu.Na.Ka.No.1048/A1/2017 dated 22.12.2017 of appointment of the 6th respondent.

2. The Writ Miscellaneous Petition in W.M.P.No.19031 of 2023 has been filed to implead the proposed respondent as 6th respondent in the above writ petition. The 5th respondent was not appointed as set out in the writ petition. Actually, it was the 6th respondent, who was appointed to the post of Mini Anganwadi Worker. Consequently, the present application has been taken out to implead the correct person as 6th respondent in the writ petition. The 6th respondent is a proper necessary party. Instead of 6th respondent, the 5th respondent have been impleaded and 6th respondent ought to be heard before final orders are passed. In fact, it is also seen that the 6th respondent is already a respondent /party in the connected writ petitions already before this Court. No prejudice would therefore be caused to the 6th respondent if she is impleaded in this writ petition and is heard before a final order is passed.

3. The Writ Miscellaneous Petition in W.M.P.No.19034 of 2023 has been filed to permit the petitioner to amend the relief. Originally, the writ petition has been filed for issuance of a writ of mandamus. However, the present miscellaneous petition is seeking amendment to the prayer from issuance of writ of mandamus to issuance of writ of certiorarified mandamus by challenging the order of appointment of the 6th respondent. 1/2 https://www.mhc.tn.gov.in/judis

4. The learned Special Government Pleader for the respondents 1 to 4 has no serious objection for allowing these applications.

5. This Court has perused the affidavit filed in support of these applications and is satisfied with the reasons set out therein.

6. Accordingly, these miscellaneous petitions are ordered as prayed for.

7. Post the main case on 05.07.2023.
